Dismissal Law in Ireland 2nd edition

Dismissal Law in Ireland, 2nd edition
Written by Dr Mary Redmond

For legal practitioners, HR managers, trade unionists and all who practice employment law, this book has been a key source of information since it was first published. Since the first edition in 1999, there have been significant developments in the jurisprudence of the High and the Supreme Court, for instance, in relation to injunctions and to the implied obligation of mutual trust and confidence. These decisions as well as determinations of the Employment Appeals Tribunal are examined, with the author extracting guiding principles.

The book covers all relevant legislation, including the many amendments to the Unfair Dismissals Act 1977, and it provides expert guidance for employers and employees on their respective rights and legal obligations regarding termination of employment under the common law as well as unfair dismissals legislation.

Employment lawyers will be reaching for their chequebook to buy the second edition of this excellent work by Mary Redmond. Simply a must have for specialist employment lawyers, employers or those involved in any aspect of employment law. Redmond deals with wrongful dismissal and unfair dismissal in a most comprehensive manner. An example of her rigorous approach is how she deals with the effect of the ECHR Act 2000 on EAT decisions – not much effect yet due to our constitutional protections, but this does not prevent her from suggesting a framework which may be applicable should a particular case merit further examination (p.282). This framework serves as a useful checklist for practitioners when considering EAT cases and which may, if applied actually bring the 2000 Act into EAT cases where it is justified.
